This policy is part of the MairyAI Terms of Service. It explains what MairyAI tells your callers, and what you are responsible for.
1. What every caller hears
Mairy identifies itself before any conversation starts. The announcement is the first thing a caller hears — before any question, and before anything is recorded or transcribed.
When recording and transcripts are enabled for your workspace:
"Thank you for calling [Business Name]. You're speaking with an AI assistant — an automated virtual receptionist, not a human. This call is recorded and transcribed. If you'd prefer to speak with a person, say 'human' at any time."
When they are not:
"Thank you for calling [Business Name]. You're speaking with an AI assistant — an automated virtual receptionist, not a human. If you'd prefer to speak with a person, say 'human' at any time."
2. How the announcement works
- It comes first. Nothing is recorded, transcribed, or stored before the caller has heard it.
- It is spoken, not a beep. A tone alone is not used.
- It is spoken at a normal pace, not compressed or rushed.
- It cannot be turned off, shortened, reworded, delayed, or reordered. The only part you control is your business name.
- It is recorded inside the recording. When recording is on, the recording begins before the announcement, so the announcement is part of the audio file.
- It is logged. Every call record shows which version of the announcement played and that it played. You can see this in your dashboard, and it is your evidence that the caller was told.
3. Our compliance approach
State laws on call recording differ. A number of states require every party on a call to consent before it is recorded, and some of those states expressly accept a spoken announcement, recorded at the start of the call, as that consent. Other states require only that the recording not be secret.
Rather than trying to detect where each caller is and behave differently, MairyAI applies the strictest approach to every call: the announcement plays on every call, in every state, before anything is captured. It states both that the assistant is an AI and, where recording is enabled, that the call is recorded and transcribed.
Separately, a small number of states require businesses to disclose that a consumer is dealing with an AI rather than a person. The announcement is written to satisfy those requirements too, which is why it says "not a human" in plain words rather than only naming the technology.
A caller who hears the announcement and continues the call is treated as having consented to being recorded. A caller who asks for a person is handled according to your configured escalation setting.
4. What you are responsible for
Recording and transcript storage are enabled for your workspace only after you turn them on and confirm you have read this policy. By enabling them, you confirm that:
- You have decided to record your callers, and you are responsible for that decision being lawful for your business. MairyAI provides the announcement as a tool. We do not give legal advice, and we do not warrant that any configuration satisfies the law that applies to you. If you are unsure, ask your own lawyer before enabling recording.
- You will not disable, shorten, reword, delay, or work around the announcement, or ask us to. Doing so breaches the Terms of Service and may make recording unlawful.
- You will keep your business name accurate in the announcement.
- You will tell us before you go live if your business is in a regulated profession or sector, or if your calls involve health, financial, legal, or similar regulated matters. Some of these carry extra disclosure duties that the standard announcement does not cover, and some are excluded from the Service entirely under the Terms.
- You will give any other notice your business owes — your website privacy notice, on-hold messages, printed notices, or anything else required of you.
- You will honour caller requests about the recording, including a request not to be recorded, a request to speak to a person, and a request to delete a recording. Tell us and we will help you action deletions.
- You will choose a retention period you can justify. When recording is enabled the default is 30 days, which is also the maximum.
- You will not use the Service for the purposes excluded by the Terms — including outbound telemarketing, emergency or crisis lines, or collecting card, bank, government ID, health, or biometric details by voice.
5. Changes
We may update this policy. If we change the announcement wording or how it is delivered, we will tell you at least 30 days in advance, unless a change is needed sooner to comply with law.
